Lawyer Advertiser Agreement for Advicey.com (version 2.3, October 2026). Placement: a sealed bid that orders your card among the cards a poster sees, and, if the poster picks you, the poster's contact and case details (an introduction). You are not buying a recommendation, a referral, a client or…
1. What you are buying
Placement: a sealed bid that orders your card among the cards a poster sees, and, if the poster picks you, the poster's contact and case details (an introduction). You are not buying a recommendation, a referral, a client or a share of anyone's legal fees. Advicey does not recommend you and says so on every card.
2. Eligibility
Each bidding lawyer must hold an active license in good standing in the case's state. You give us your bar numbers; we check them against each state's public records and re-check every 90 days. Tell us within 5 days of any change in status, any public discipline, or any lapse in professional liability insurance.
3. Fee Schedule
The minimum single-case bid, the per-member Pool minimum and any Pool listing fee are shown in your dashboard and on the bid form before you bid (the "Fee Schedule"). We may change the Fee Schedule for future bids with 30 days' notice in your dashboard. The Fee Schedule is not public.
4. Bids, holds and the three fee types
- Each state uses one of three fee types, shown on the bid form before you bid. The fee type depends on the state of the case (or the Pool's claim state).
- Pay when picked: a hold is placed on your card when you bid and renewed automatically before it expires. If a renewal fails, your bid is withdrawn. If the poster does not pick you, or the pick window ends, your hold is released and you pay nothing. If the poster picks you (or the Pool votes for you), your card is charged the bid amount when the poster's contact details are released to you.
- Flat lead fee: every firm pays the same fixed amount shown on the bid form (for a Pool, the Pool minimum). It works like Pay when picked: a hold when you bid, charged only if the poster picks you (or the Pool votes for you), released otherwise. Cards are shown in random order, not by payment, and the amount can't be raised.
- Pay to be shown: your card is charged the bid amount when you place the bid. That is the price of your card being shown to this client, ordered by amount. It is the same whether or not the client picks you, and it is not refunded if they pick another firm or no one. If you raise the bid, the difference is charged.
- You may raise a bid. You may not lower or withdraw a bid after the poster may have seen it, except for a conflict of interest you identify; we log it and release the hold.
- The client fee on your bid (a maximum contingency percentage, "set by law," a flat fee, an hourly rate, or a free consultation) is the fee you commit to offer this client in your retainer for this matter.
5. Refunds
Pay to be shown: refunded in full if Advicey removes your card (a pitch or license we don't approve) or the case closes before your bank approves the charge; otherwise not refunded. Pay when picked: full refund if you were picked but the poster's contact details were invalid, if we verify the poster was already represented or the matter was fraudulent, or if Advicey made an error. No refund because a poster who picked you later decides not to hire you. The fee pays for the introduction, and state ethics rules (for example NYSBA Op. 1294) require that it not depend on whether you are retained.
6. Pitch and advertising rules
- Truthful and not misleading. No guarantees or predictions of results.
- No "best," "top," "#1," "expert" or "specialist" unless certified by a body your state recognizes (name it).
- No dollar results without the disclaimer your state requires.
- No phone numbers, emails, links or other contact details.
- Your pitch is your advertisement. You are responsible for your state's advertising rules, including filing it with your state's regulator where required (Alabama, Connecticut, Louisiana, Mississippi, Nevada and others) and keeping copies for the required period. Where a state requires filing before an ad runs, the bid form asks you to confirm the filing.
- You can download every pitch you submitted, with the date and state it was shown, for 3 years.
7. After you are picked
- Contact the poster within 24 hours and log it truthfully.
- Run your own conflict check and make your own decision whether to take the matter.
- If you sign a retainer, confirm it in your dashboard within 30 days of being picked.
- Never pay or give the poster anything to hire you. Advicey's bounty is Advicey's alone.
- Client information you receive is your responsibility under your professional duties and privacy law. Use it only to evaluate and handle the matter.
8. Pools and client funds
If you represent Pool members, you handle client funds and any third-party interests in them as the rules of professional conduct require. Nothing in this agreement limits your independent professional judgment or your duty to your client.
9. Strikes and suspension
A strike is given for a verified missed contact, a false contact log, abusive conduct, a pitch that breaks the rules after warning, or trying to obtain a poster's details before being picked. 3 strikes in 12 months suspends the account. You may appeal once through the Complaints Policy.
10. Non-circumvention
You will not use Advicey to contact posters outside the platform before you are picked, scrape or copy redacted cases, or try to identify a poster from a redacted summary.
11. Payments, taxes and chargebacks
You authorize the holds and charges described here. Fees do not include taxes; you pay any that apply. A chargeback on a valid charge pauses your account until resolved.
12. Your promises and indemnity
You promise that your licenses, insurance and discipline disclosures are true and current, and that your pitches comply with the law. You will defend and pay Advicey for claims arising from your legal services, your advertising, or your breach of this agreement.
13. Independence
You are an independent professional. Advicey does not direct, supervise, or share in your legal fees, and nothing here is a fee-sharing, partnership or referral arrangement.
14. Limits on liability
Advicey's total liability to your firm for all claims relating to this agreement is limited to the fees you paid Advicey in the 6 months before the claim. Neither side is liable for indirect or consequential damages, except for your indemnity duties and breaches of confidentiality.
15. Term
Either side may end this agreement on notice. Holds on open bids are cancelled; obligations about client funds, records, indemnity and disputes continue.
16.1 Talk to us first
Before starting an arbitration or court case, the person bringing the claim must send a written Notice of Dispute to legal@advicey.com (if you are bringing it) or to your account email (if we are). The notice must describe the claim and the relief wanted. Both sides will try in good faith to resolve it for 60 days. During that time, deadlines to bring the claim are paused.
16.2 Binding individual arbitration
If the dispute is not resolved, it will be decided by binding arbitration, not in court, except as listed in 16.5. The Federal Arbitration Act governs this section. The American Arbitration Association (AAA) runs the arbitration under its Consumer Arbitration Rules (for posters and Pool members) or its Commercial Arbitration Rules (for law firms), as in effect when the arbitration starts. The arbitration is seated in New York, New York, and New York law applies to the merits except where your state's law protects you more. Hearings will be held by video or phone unless the arbitrator decides an in-person hearing is needed. For a consumer, any in-person hearing takes place in the county where you live unless you agree otherwise.
16.3 No class actions and no jury
Each side may bring claims only for itself, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine more than one person's claims and may give relief only to the person bringing the claim. YOU AND ADVICEY EACH GIVE UP THE RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION. If this paragraph is found unenforceable for a particular claim, that claim (and only that claim) goes to court and is paused until the individual arbitration ends.
16.4 Fees
For consumers, Advicey pays all AAA filing, administration and arbitrator fees beyond the amount you would pay to file in court, unless the arbitrator finds your claim was frivolous or brought for an improper purpose. Each side pays its own lawyers unless the law or the arbitrator awards otherwise.
16.5 What is not arbitrated
Either side may bring an individual claim in small claims court if it qualifies. Either side may ask a court for an order to stop misuse of its intellectual property, accounts or systems. Nothing here stops you from reporting a lawyer to a state bar, reporting a business to a government agency, or taking part in a government investigation. Claims that a law says cannot be forced into arbitration are also excluded.
16.6 Many similar claims
If 25 or more similar demands are filed by or with help from the same lawyers or organizations, the AAA Mass Arbitration Supplementary Rules apply. The demands will be handled in batches of up to 25, with one arbitrator per batch, and fees will follow those rules. Deadlines to bring the claims are paused while they wait.
16.7 Who decides
The arbitrator decides all questions about whether a claim must be arbitrated, except that a court decides questions about the class-action waiver in 16.3 and about 16.6.
16.8 Your right to opt out
You may opt out of this arbitration agreement within 30 days after you first accept these terms, by emailing legal@advicey.com from your account email with the subject "Arbitration opt-out" and your name. Opting out does not affect the rest of these terms, and it does not affect any earlier arbitration agreement you made with us.
16.9 Changes
If we change this arbitration section, the change does not apply to a dispute that started before the change. You may reject a material change by emailing legal@advicey.com within 30 days after we post it; the prior version then continues to apply to you.
17. Governing law
New York law governs this agreement, and the Federal Arbitration Act governs Section 16.
18. Partner plan (optional, yearly)
- You may buy a yearly Partner plan for $6,000. It gives you $7,200 in placement credit for the plan year (a 20% bonus).
- Credit is applied automatically to placement fees and winning Pool bids when you are picked. Only the rest, if any, is charged to your card. A refund under Section 5 puts the credit back.
- Credit has no cash value, can't be transferred, and expires at the end of the plan year. The yearly fee is not refundable, except where the law requires.
- Partners see new single cases in their licensed states and followed practice areas up to 2 hours before other firms. After that, every eligible firm can see and bid on them.
- The plan never changes the order of bids, which is always the placement amount. Clients are never told which firms are Partners, and Partners are not described as recommended, preferred or better.
- The fee is a flat advertising cost. It never depends on whether anyone contacts or hires your firm, or on the outcome of any matter.
- The plan renews every year until you cancel. We email you 30 days before renewal. If you cancel, benefits continue until the end of the paid year.
